1. Introduction
These Terms of Service govern the terms and conditions regarding the use of the Asistan 7/24 platform ("Platform"). By using the Platform, you are deemed to have accepted these terms. Asistan 7/24 is a CRM and appointment management platform for clinics that unifies WhatsApp, Instagram, and phone communications with Google Calendar integration in a single dashboard.
2. Definitions
- Platform: The Asistan 7/24 web application and all related services
- Company: TEKMED TIBBİ DANIŞMANLIK SAĞLIK HİZMETLERİ VE EKİPMAN TİCARET LİMİTED ŞİRKETİ (VKN: 8360998267, Vergi Dairesi: Çorlu, Adres: Hürriyet Mah. Başmaslak 1. Sk. No: 3 BB Çorlu/Tekirdağ)
- User: Any natural or legal person using the Platform (clinic managers, healthcare professionals, and authorized personnel)
- Service: All features and functionalities provided through the Platform
3. Scope of Service
The Asistan 7/24 platform provides the following services:
- Unified Inbox: Managing all communications from WhatsApp, Instagram, and phone channels in a single dashboard
- Appointment Management: Creating, tracking, and managing appointments with Google Calendar integration
- Patient Communication Records: Centralized storage of all patient/client communication history
- Automated Notifications: Automatic sending of appointment reminders and notifications
- Reporting: Generating detailed reports on communication and appointment data
- Multi-Channel Communication: WhatsApp Business API, Instagram Messaging API, and phone integration
4. Account and Security
You must create an account to use the Platform. Responsibilities regarding account security:
- You are responsible for maintaining the confidentiality of your account information
- You must not share your login credentials (username and password) with third parties
- You are responsible for all activities carried out through your account
- You must immediately notify the Company if you detect unauthorized access
- The use of strong passwords and regular password changes is recommended
5. Usage Rules
5.1. Acceptable Use
The Platform must be used solely for the purpose of clinic communication and appointment management. Users must:
- Use the Platform in compliance with all applicable laws
- Process patient/client data in accordance with the relevant legislation
- Adhere to professional standards in all communications sent through the Platform
5.2. Prohibited Activities
The following activities are strictly prohibited:
- Engaging in activities that may compromise the security of the Platform
- Using the Platform for unlawful purposes
- Sending spam or bulk unsolicited messages
- Performing actions that could damage the Platform's infrastructure
- Preventing other users from accessing the service
- Attempting to reverse-engineer the Platform's source code
- Sublicensing the Platform to third parties
6. Intellectual Property
The Asistan 7/24 platform, including all software components, designs, logos, trademarks, and content, is the exclusive property of TEKMED TIBBİ DANIŞMANLIK SAĞLIK HİZMETLERİ VE EKİPMAN TİCARET LİMİTED ŞİRKETİ. Users are granted only the right to use the Platform; no intellectual property rights are transferred.
Users may not copy, reproduce, distribute, or create derivative works from any component of the Platform without the prior written consent of the Company.
7. Data Protection
Personal data processed through the Platform is protected under Law No. 6698 on the Protection of Personal Data (KVKK) and related legislation. For detailed information on the processing of personal data, please review our Privacy Policy and Data Protection & GDPR pages.
Users are responsible for fulfilling their obligations under KVKK as data controllers with respect to patient/client data they process through the Platform.
8. Service Modifications
The Company reserves the following rights:
- Updating, modifying, or removing Platform features
- Adding new features and services
- Changing service terms and pricing
- Temporarily suspending the service for maintenance and updates
Users will be notified within a reasonable time in advance of significant changes.
9. Limitation of Liability
The Company does not guarantee that the Platform will operate without interruption or error. The Company shall not be held liable for damages arising from the following circumstances:
- Service interruptions due to technical failures, server outages, or maintenance work
- Interruptions or changes in third-party services (WhatsApp, Instagram, Google)
- Unauthorized access resulting from the User's failure to keep account information secure
- Force majeure events (natural disasters, war, regulatory changes, etc.)
- The accuracy and currency of data uploaded to the Platform by the User
In any event, the Company's total liability shall not exceed the service fees paid by the User in the preceding 12 months.
10. Termination
Termination conditions regarding the Terms of Service:
- By the User: The User may terminate the service at any time by closing their account
- By the Company: The Company may suspend or permanently close the accounts of users who violate the Terms of Service
- Post-Termination: Upon account closure, the User's data on the Platform will be deleted, taking into account statutory retention periods
11. Governing Law and Dispute Resolution
These Terms of Service are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Çorlu shall have jurisdiction over any disputes that may arise from these terms.
